Privacy Policy

This privacy policy explains how your Personally Identifiable Data (PID) is being collected and used by Business IT Systems Pte Ltd, as used in Singapore law, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context.

What personal information do we collect?

Account & Contact data: When you register on our website to use or download one of our products, or to subscribe to one of our services, or fill in one of our contact forms, you voluntarily give us certain information. This typically includes your name, company name, email address, and sometimes you phone number, postal address (when an invoice is required), business sector and interest in BiTS, as well as a personal password.

We never store credit card information, and always rely on trusted third-party PCI/DSS-compliant services such as Paypal, Stripe or Ingenico Payment Services for credit card processing, including for recurring payment processing.

Browser data

When you visit our website and access our online services, we may detect and store your browser language and geolocation, in order to customize your experience according to your country and preferred language. Our servers also passively record a summary of the information sent by your browser, for statistical and legal purposes: your IP address, the time and date of your visit, your browser version and platform, and the web page that referred you to our website.

Customer data

When you subscribe to a BiTS hosted service and create your own BiTS database, any information or content you submit or upload into your database is your own, and you control it fully. This may include, for example: your list of contacts and customers, your messages, pictures, videos, etc. BITS only ever collects this information on your behalf, and you always retain ownership and control of this data.

How do we use this information?

Account & Contact data: We regularly need to use your contact information in order to answer your requests, or for billing and account management reasons. We may also use this information for our own marketing and communication purposes (this always comes with a way for you to opt-out at any time). We also use this data in aggregated/anonymised form in order to analyze service trends.

In addition, if you have expressed interest in using BiTS or otherwise asked to be contacted by an BiTS service provider, we may transfer your name, email address, phone number and company name to one of our official Partners in your country or region, for the sole purpose of contacting you to offer their local assistance and services.

Browser data

Automatically recorded data is anonymously analyzed in order to maintain and improve our services. We will only correlate this data with PID when required by law or in case of violation of our Acceptable Use Policy.

Customer data

BiTS Helpdesk staff and BiTS engineers may access this information in a limited and reasonable manner in order to solve any issue with the service, or at your explicit request for support reasons, or as required by law, or to ensure the security of our services in case of violation of our Terms of Use.

Security 

We realize how important and sensitive PID is, and take a great number of measures to ensure that this information is securely processed, stored and preserved from data loss and unauthorized access. You may learn more about our confidentiality and security measures on our BiTS Security page.

While we endeavour to protect the privacy of your Personal Information we hold in our records, we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

The Services may contain links to other sites. We are not responsible for the privacy policies and/or practices on other sites. When following a link to another site you should read that site's privacy policy.

Accessing, Updating or Deleting Your Personal Information

We give you access to your data via your personal account on bitsbi.com. You can sign up at any time to access, update or delete your personal information.

You may access and edit billing information by logging into https://bitsbi.com and navigating to [YOUR NAME] > My Account.

You may access and edit contact information and notification options by logging into https://bitsbi.com/web and navigating to [YOUR NAME] > Preferences.

If you have any questions about viewing or updating information we have on file about you, please contact us at support@bitsbi.com.

If you wish to have your personal account and personal information deleted on bitsbi.com, you can contact legal@bitsbi.com to make a request. We will take all reasonable steps to permanently delete your personal information, except for the specific information we are required to keep for legal reasons (for example, customer details as printed on our own invoices).

Please note that as part of our security policy, we always try to preserve your data from accidental or malicious deletion. As a result, after deleting your personal information, it may not be immediately deleted on our servers, and may not be deleted from our backups. It will however be made inaccessible except for recovery purposes.

Cookie Policy

Cookies are small bits of information sent by our servers to your computer or device when you access our services, and unique to you. They are stored in your browser and later sent back to our servers so that we can provide contextual content. We use them to remember your session (so you don't have to login again), your shopping cart, etc.

They are also used to help us understand your preferences based on previous or current site activity, your language and country, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future.

We also use third-party services such as Google Analytics, who may set and use their own cookies to identify visitors and provide their own contextual services.

You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser settings. Each browser is a little different, so look at your browser's Help menu to learn the correct way to modify your cookies.

We do not currently support Do Not Track signals, as there is no industry standard for compliance.

Third Party Disclosure

We do not sell, trade, or otherwise transfer to third parties your personally identifiable information.

We may share or disclose aggregated or de-identified information, for research purposes, or to discuss trends or statistics with third-parties, prospects, etc.

General Data Protection Regulation (GDPR)

EU Residents

If you are a resident of the European Union ("EU"), United Kingdom, Lichtenstein, Norway, or Iceland, you may have additional rights under the EU General Data Protection Regulation (the "GDPR") with respect to your Personal Data, as outlined below.

For this section, we use the terms "Personal Data" and "processing" as they are defined in the GDPR, but "Personal Data" generally means information that can be used to individually identify a person, and "processing" generally covers actions that can be performed in connection with data such as collection, use, storage and disclosure. Company will be the controller of your Personal Data processed in connection with the Services. Note that we may also process Personal Data of our customers' end users or employees in connection with our provision of services to customers, in which case we are the processor of Personal Data. If we are the processor of your Personal Data (i.e., not the controller), please contact the controller party in the first instance to address your rights with respect to such data.

If there are any conflicts between this section and any other provision of this Privacy Policy, the policy or portion that is more protective of Personal Data shall control to the extent of such conflict. What Personal Data Do We Collect From You?

We collect Personal Data about you when you provide such information directly to us, when third parties such as our business partners or service providers provide us with Personal Data about you, or when Personal Data about you is automatically collected in connection with your use of our Services.

Information we collect directly from you: We receive Personal Data directly from you when you provide us with such Personal Data, including without limitation the following:

  • Company name

  • Email address

  • Mailing address

  • Telephone number

  • Credit card and credit card CVV

  • Billing address

  • Transaction and Billing Data If you choose to integrate BiTS with 3rd party applications, remember that their use of your information will be governed by their privacy policies and terms.

How Do We Use Your Personal Data?

We process Personal Data to operate, improve, understand and personalize our Services. For example, we use Personal Data to:

  • Create and manage user accounts

  • Communicate with you about the Services

  • Process orders

  • Contact you about Service announcements, updates or offers

  • Provide support and assistance for the Services

  • Personalize website content and communications based on your preferences

  • Respond to user inquiries

  • Fulfil user requests

  • Resolve disputes

  • Protect against or deter fraudulent, illegal or harmful actions

  • Enforce our Terms of Service We will only process your Personal Data if we have a lawful basis for doing so. Lawful basis for processing include consent, contractual necessity and our "legitimate interests" or the legitimate interest of others, as further described below.

  • Contractual Necessity: We process the following categories of Personal Data as a matter of “contractual necessity”, meaning that we need to process the data to perform under our Terms of Service with you, which enables us to provide you with the Services. When we process data due to contractual necessity, failure to provide such Personal Data will result in your inability to use some or all portions of the Services that require such data.

How and With Whom Do We Share Your Data?

We share Personal Data with vendors, third party service providers and agents who work on our behalf and provide us with services related to the purposes described in this Privacy Policy or our Terms of Service. These parties include:

  • Payment processors

  • Fraud prevention service providers

  • Hosting service providers

  • Co-location service providers

  • Telecommunications service providers We also share information with third parties when you have given us consent to do so (as indicated at the point such information is collected).

  • Maintain the security of our products and services Furthermore, if we choose to buy or sell assets, user information is typically one of the transferred business assets. Moreover, if we, or substantially all of our assets, were acquired, or if we go out of business or enter bankruptcy, user information would be one of the assets that is transferred or acquired by a third party, and we would share Personal Data with the party that is acquiring our assets. You acknowledge that such transfers may occur, and that any acquirer of us or our assets may continue to use your Personal Information as set forth in this policy.

How Long Do We Retain Your Personal Data?

We retain Personal Data about you for as long as you are a customer. In some cases, we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation.

Afterwards, we retain some information for marketing and promotional activities, unless you have opted out of such promotions.

We seek to protect Personal Data using appropriate technical and organizational measures based on the type of Personal Data and applicable processing activity.

What Rights Do You Have Regarding Your Personal Data?

You have certain rights with respect to your Personal Data, including those set forth below. For more information about these rights, or to submit a request, please email legal@bitsbi.com Please note that in some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it is not required by law, but in those circumstances, we will still respond to notify you of such a decision. In some cases, we may also need you to provide us with additional information, which may include Personal Data, if necessary to verify your identity and the nature of your request.

  • Access: You can request more information about the Personal Data we hold about you and request a copy of such Personal Data.

  • Rectification: If you believe that any Personal Data we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data.

  • Erasure: You can request that we erase some or all of your Personal Data from our systems.

  • Withdrawal of Consent: If we are processing your Personal Data based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time. Please note, however, that if you exercise this right, you may have to then provide express consent on a case-by-case basis for the use or disclosure of certain of your Personal Data, if such use or disclosure is necessary to enable you to utilize some or all of our Services.

  • Portability You can ask for a copy of your Personal Data in a machine-readable format. You can also request that we transmit the data to another controller where technically feasible.

  • Objection: You can contact us to let us know that you object to the further use or disclosure of your Personal Data for certain purposes.

  • Restriction of Processing: You can ask us to restrict further processing of your Personal Data.

  • Right to File Complaint: You have the right to lodge a complaint about Company's practices with respect to your Personal Data with the supervisory authority of your country or EU Member State.

Transfers of Personal Data:

The Services are hosted and operated in Singapore through Company and its service providers, and laws in the Singapore may differ from the laws where you reside.

By using the Services, you acknowledge that any Personal Data about you, regardless of whether provided by you or obtained from a third party, is being provided to Company in Singapore and will be hosted on Singapore servers, and you authorize Company to transfer, store and process your information to and in Singapore, and possibly other countries.

Policy Updates

We may update this Privacy Policy at any time, and will publish the changes here. If we feel any change is significant, we will notify users of our services by email.
